Can I file without proof of use?
Most jurisdictions don’t require proof of use at filing, but later may ask for intent-to-use or declarations, and non-use for three years risks cancellation. Keep usage evidence early.
Does a similarity search guarantee approval?
No guarantee, but it significantly lowers collision risks and optimizes class coverage—key for higher success rates.
How many classes should I file in?
Cover your core goods/services, consider defensive and adjacent classes. Avoid over-spread but don’t miss essentials.
Do I need to refile if my logo changes color/details?
If changes affect distinctiveness, file a new application. Color claims vs. black & white scope must also be considered.
Madrid or national filings?
Madrid is best for multi-country portfolios with centralized management. For strict-exam countries or those outside Madrid, national/regional filings are more suitable.
